1. Acceptance of Terms

By accessing or placing an order through this website, app, or any of our services (“Site”, “Services”), you agree to be bound by these Terms & Conditions and all related policies and rules published by Fresh Rags. If you do not agree, do not use this Site or place orders.

You represent that you are at least 18 years old or have obtained parental consent to use this Site.
We may revise these Terms at any time. Updates take effect immediately when posted. It is your responsibility to review this page periodically.

2. Orders, Pricing & Availability

All orders are subject to availability and verification.
We reserve the right to refuse or cancel any order at our discretion, including but not limited to pricing errors, suspected fraud, or use of automated purchasing tools.
Prices, product descriptions, images, and availability are subject to change without notice.
If an error occurs (including pricing or product info), we may cancel or modify your order and notify you accordingly.

3. Cancellations & Limitations

Orders may be canceled within 2 hour of placement, provided they have not shipped.
Once an order ships, cancellations or changes are not possible.
For limited releases or high-demand items, we may limit quantities per customer, household, or payment method. Duplicate or suspicious orders may be canceled without notice.
Automated purchasing is strictly prohibited. If we determine that an order was placed using bots or automation, we reserve the right to cancel the order, refuse returns, and/or impose restocking fees.
All orders using a 30% or more discount cannot be canceled

4. Launch & Special Releases

All launch-day products, special releases, collaborations, and limited-edition drops are FINAL SALE — no cancellations, returns, or exchanges.
Launch products are typically limited to one per customer (per style/color). Duplicate or automated orders may be canceled.
Release procedures, including FCFS, raffles, or in-store rules, may vary by drop and are subject to change at Fresh Rags’ discretion.

5. Shipping, Risk & Lost Packages

Processing Time: Orders require 3–5 business days for verification and processing.
Shipping: We ship domestically and internationally. Customers are responsible for all shipping costs and, for international orders, any duties, taxes, or import fees.
Risk of Loss: Once the package is accepted by the carrier, liability transfers to the customer. Fresh Rags is not responsible for lost, stolen, or delayed packages after carrier pickup or marked delivery.
Incorrect Addresses / Undeliverable Packages: It is the customer’s responsibility to provide accurate shipping information. Packages returned as undeliverable will receive store credit minus shipping costs.
International Orders: International customers are responsible for all duties, taxes, and import fees. Returns or exchanges are not accepted for international orders. Refused or undeliverable international shipments will not be refunded.

6. Returns, Exchanges & Store Credit

Return Window: Returns must be initiated within 3 days of delivery.
Items must be unused, unworn, unwashed, with all original tags and packaging (including boxes, inserts, and accessories) intact.
Final Sale: Items marked “Final Sale,” discounted 30% or more, launch-day products, or special collaborations cannot be returned or exchanged.
Box Condition Disclaimer: We do not offer returns or refunds for damaged, dented, or crushed shoe boxes. Minor cosmetic damage to packaging is not considered a defect. All shoes are authentic and brand new.
Store Credit Only: Eligible returns receive store credit only. No refunds to original payment methods are provided.
Return Shipping: Customers are responsible for return shipping costs. If a prepaid label is issued, the cost will be deducted from the store credit. Unauthorized or “blind” returns will not be accepted.
Defective / Incorrect Items: Must be reported within 3 days of delivery. Verified defects or incorrect items will receive a prepaid return label and store credit or replacement upon inspection.

7. Payment & Chargebacks

By placing an order, you authorize Fresh Rags to charge your selected payment method for the full order amount.
Fraudulent chargebacks or disputes will be investigated thoroughly. We reserve the right to provide proof of delivery and order information to financial institutions.
Chargeback abuse may result in your account being banned from future purchases.

8. SMS & Mobile Messaging

By opting in to receive SMS notifications, you consent to receive marketing and transactional texts from Fresh Rags. Message frequency may vary. Message and data rates may apply.
You can opt out at any time by replying STOP. For help, reply HELP or contact us at [support email].
Your information is handled according to our Privacy Policy.

9. Resellers & Bulk Buyers

Purchases are intended for personal use only.
We reserve the right to cancel any orders placed for resale, bulk distribution, or commercial purposes — including multiple orders using different names, emails, or addresses.
Accounts or buyers found engaging in bulk/resale activity may be restricted from future launches and site usage.

10. Prohibited Use & Conduct

You agree not to:

Use the Site for illegal or unauthorized purposes.
Reverse engineer, copy, modify, or distribute Site content.
Use bots, scrapers, or automated tools to access the Site.
Resell products without express written permission.
Violations may result in order cancellation, account termination, and/or legal action.

11. Intellectual Property

All Site content — including images, text, trademarks, logos, and software — is owned by Fresh Rags or its licensors. You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use only.
Unauthorized reproduction, modification, or distribution is strictly prohibited.

12. Disclaimers & Limitation of Liability

The Site and products are provided “as is,” without any warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent allowed by law, Fresh Rags is not liable for any indirect, incidental, special, or consequential damages, including lost profits, arising from your use of the Site or products.
In no event will our total liability exceed the purchase price of the product in question.

13. Indemnification

You agree to indemnify and hold harmless Fresh Rags, its affiliates, employees, contractors, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising out of your breach of these Terms or misuse of the Site.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
All disputes will be resolved in the courts of Pinellas County, Florida.
By using this Site, you consent to this jurisdiction and venue.

15. Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
Failure to enforce any right does not constitute a waiver of that right.

16. Additional Terms

Privacy Policy: Your use of this Site is also governed by our Privacy Policy.
Third-Party Links: We are not responsible for content or practices of linked third-party sites.
Entire Agreement: These Terms constitute the full agreement between you and Fresh Rags and supersede any prior agreements.

2025
